5.2. Cash on Delivery (COD) Policy

For customers who prefer to pay upon delivery, Salvya offers Cash on Delivery (COD) in selected locations.

 

COD Terms & Conditions:

COD is only available in eligible countries/regions (shown at checkout).

A COD handling fee may apply, depending on the delivery location.

Customers must prepare the exact cash amount as couriers may not carry change.

COD orders must be confirmed via phone or email before shipping.

 

If a COD order is refused or not accepted, future COD orders may be restricted for that customer.

 

If COD is unavailable in your area, please choose an alternative payment method.

Tax-Free shopping is not available at this time, as all applicable taxes are included in the product price based on the destination country’s regulations.

We offer several shipping options based on your location and preference:

 

Standard Shipping – Economical option with delivery times typically between 21-30 business days (depending on the destination).

 

Express Shipping – Faster service with delivery times typically between 17-21 business days (available in select regions).

 

Premium Delivery – For faster service with guaranteed delivery times, typically within 10-17 business days (available in select areas, with higher shipping fees).

 

Cash on Delivery (COD) – Available only in select countries, this method allows you to pay when the order is delivered.

Shipping Fees:

Shipping costs are calculated at checkout based on the weight of your order, delivery destination, and the shipping method chosen.

For orders over €100, we offer free standard shipping to select countries.

Return Instructions: Once the return is authorized, we will send you specific instructions on how to return the item, including the return shipping address.

Return the Item: Pack the item securely in its original packaging (if available) and return it to the address provided. Please note that you will be responsible for the return shipping costs unless the item was defective or incorrect.

Inspection & Approval: Once we receive the returned item, our team will inspect it to ensure it meets our return criteria. If approved, we will process a refund or exchange as per your preference.

7.3. Exchanges

We are happy to offer exchanges for defective or incorrect items. Exchanges are subject to availability. To exchange an item, please follow the steps outlined above under How to Request a Return or Exchange.

Exchanges are available for:

Wrong size: If the size you ordered does not fit, we will exchange it for the correct size, if available.

Defective or damaged items: If your item is defective or damaged during shipping, we will send you a replacement.

Exchanges are not available for:

Items that are customized or printed specifically for your order (such as custom designs, limited edition items, or sale items).

Change of mind or non-defective items.

7.5. Non-Returnable/Non-Exchangeable Items

Please note that Salvya does not accept returns or exchanges for the following items:

Custom-made products: Any product that has been personalized, including custom prints, personalized embroidery, etc.

Sale/Discounted items: Items purchased during sales or with a discount may be final sale.

Gift cards: Once a gift card has been purchased, it is non-refundable.

7.6. Shipping Costs for Returns

If your return is due to a defective or incorrect item, we will cover the return shipping costs. We will send you a pre-paid return label to use for sending the product back.

If your return is for any other reason (e.g., change of mind, wrong size, unwanted gift), you will be responsible for the cost of returning the item to us. Salvya will not cover the return shipping costs in these cases.

7.7. Late Returns

We cannot accept returns or exchanges beyond 48h from the date of delivery. After this period, we are unable to offer refunds, replacements, or exchanges.

7.8. Lost Returns

Salvya is not responsible for items lost during the return shipping process. We strongly recommend using a trackable shipping service or purchasing shipping insurance for the return. We cannot process refunds or exchanges for items that are lost in transit.

7.9. Disputes or Issues

If you encounter any issues with your return, exchange, or refund, or if you believe that you were wrongly refused a return or exchange, please contact our Customer Support team immediately. We will investigate the matter and resolve the issue to the best of our ability.

While we strive to fulfill all orders, Salvya reserves the right to cancel an order under certain circumstances, including but not limited to the following:

Payment Issues: If we are unable to process your payment or if there is an issue with the payment method (e.g., expired credit card, insufficient funds), we may cancel your order.

Product Availability: In the rare case that the product you ordered is out of stock or unavailable (even after confirming your order), we may cancel the order and notify you accordingly.

An event of force majeure refers to any unforeseen circumstance or occurrence that is outside of the control of Salvya, which makes the performance of our contractual obligations impossible, impractical, or delayed. This includes, but is not limited to:

War, civil war, or acts of terrorism.

Labor strikes, lockouts, or industrial disputes.

Failure of suppliers or subcontractors to meet their obligations.

 

Any other events or circumstances that are beyond the reasonable control of Salvya.

11.2. Notice of Force Majeure

In the event that Salvya is unable to perform its obligations due to an event of force majeure, we will make reasonable efforts to notify customers as soon as practicable through the provided contact information or via an appropriate communication channel (e.g., email, website notice).

However, Salvya is not required to provide a notice if the circumstances preventing performance are transient or if the delay is minimal in nature.

11.3. Suspension of Performance

12. GOVERNING LAW & DISPUTES

12.1. Governing Law

By using our services and purchasing products from Salvya, you agree to submit to the exclusive jurisdiction of the courts located in Morocco for the resolution of any disputes.

Although Salvya operates in multiple countries, including Italy and the UK, the legal framework governing your purchases and services from Salvya will always be the laws of Morocco, as Salvya's base of origin and primary operations are based in Morocco. Products are designed, produced, and made in Morocco, and this is an integral part of our brand identity.

12.2. Dispute Resolution

In the event of a dispute, controversy, or claim arising out of or relating to these Terms & Conditions, including any questions regarding their existence, validity, or termination, both parties (you and Salvya) agree to attempt to resolve the dispute in an amicable manner before resorting to formal legal proceedings.

12.2.1. Negotiation & Mediation

Step 1: Initial Negotiation: If you have a dispute, you agree to first attempt to resolve the matter through informal negotiation by contacting Salvya's customer service team or designated contact person.

 

Step 2: Mediation: If the dispute remains unresolved after a reasonable period of negotiation, either party may request mediation through an independent mediator from The Chambers of Commerce, Industry, and Services (CCIS), or any other recognized institution agreed upon by both parties.

The mediator will attempt to facilitate a resolution of the dispute in a confidential and informal manner.

 

Mediation is a non-binding process, and either party may choose to proceed to the next steps if the dispute remains unresolved.

12.2.2. Arbitration (If Mediation Fails)

If the dispute is not resolved through negotiation or mediation within 30-60 days, either party may elect to submit the matter to binding arbitration under the rules of The Chambers of Commerce, Industry, and Services (CCIS).

The arbitration shall be conducted in Marrakech, Morocco or at another location as agreed upon by both parties.

 

The language of the arbitration will be English, Arabic, or French depending on the location and preferences of the parties.

 

The decision of the arbitrator(s) will be final and binding on both parties, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

12.2.3. Jurisdiction & Venue

In the event that arbitration does not resolve the dispute, both parties consent to the exclusive jurisdiction and venue of the courts in Marrakech, Agadir, or Laayoune (Morocco) depending on the location of the issue. These courts will have sole and exclusive jurisdiction over the dispute.

 

If the dispute arises from the Italian or UK branches, the parties consent to the exclusive jurisdiction of the courts in Bergamo (Italy) or Edinburgh (UK), as applicable.

12.3. Class Action Waiver

To the fullest extent permitted by law, both parties agree that any dispute resolution proceedings, whether in arbitration or litigation, will be conducted on an individual basis and not as part of any class, consolidated, or representative action. You waive any right to participate in or bring any class action, group action, or similar collective proceeding against Salvya.

12.4. Limitation of Actions

You agree that any claim or cause of action arising out of or related to your use of the website, these Terms & Conditions, or any related services must be brought within [1-2] years after the event giving rise to the claim occurred. After this period, any claim or cause of action will be barred, and you will no longer have the right to bring an action or seek any remedy.

12.5. Costs of Dispute Resolution
